Funding

 

There is no longer Legal Aid available for family cases such as divorce, private children applications or applications relating to financial settlements.

It is therefore very important that you understand the likely costs associated with your divorce or family case and how you will be able to pay those costs.

We will always explain all the likely costs with you at the outset and update you throughout your case in respect of any changes to our estimates.  We are also able to offer you fixed fees for a lot of the family work that we undertake.  If you are paying on an hourly rate basis we will bill you monthly so that the cost of the work is spread out and more manageable for you and you can keep an eye on how your costs are mounting as the case progresses.

The more that you can agree amicably with your partner the cheaper your case will be.  If you are able to reach an amicable agreement together we can offer a fixed fee to implement the agreement for you.  Mediation is also a cheaper option than instructing a solicitor to negotiate your settlement but again once agreement is reached we can offer fixed fees to implement the agreements and make them legally binding for you.

It is important that you give consideration as to how you will be able to fund your case and some options are:

  • From income or savings;

  • By using a loan, credit card or overdraft;

  • Borrowing from family or friends;

  • Taking out a litigation loan;

  • In some circumstances applying to the court for an order that the other party be responsible for your costs.

If you opt for our fixed fee options then we do require the full amount from you at the outset before any work is undertaken.

If you wish to set a monthly budget for the work you can afford us to do then please discuss this with us and we will happily comply.  You must be aware though that if court proceedings have been started and there are hearings listed it may be difficult to stick within that monthly budget.
